1. Introduction

This document outlines the terms and conditions for using Egoist ("the Service"). By accessing or using the Service, you agree to be bound by these terms.

2. Definitions

  • "User," "you," and "your" refer to the individual or entity using the Service
  • "We," "us," and "our" refer to Egoist
  • "Content" refers to any information, data, text, software, music, sound, photographs, graphics, videos, or messages

3. User Accounts

  • Users are responsible for maintaining the confidentiality of their account credentials.
  • Users are responsible for all activities occurring under their account
  • We reserve the right to suspend or terminate accounts for violations of these terms

4. Acceptable Use

Users agree not to:

  • Violate any applicable laws or regulations
  • Upload inappropriate content that isn't gym related such as pornography.
  • Infringe upon intellectual property rights
  • Upload or use copyrighted or trademark-protected audio without all required rights and permissions. There is no fixed legal rule that makes short clips (for example, a specific number of seconds) automatically allowed.
  • Distribute malware or harmful code
  • Engage in unauthorized data collection
  • Interfere with the proper functioning of the Service

5. Content and Intellectual Property

  • Users retain ownership of their content
  • Users represent and warrant that they own or otherwise control all rights needed to upload, store, transmit, and share their content through the Service, including rights in audio, performances, trademarks, and likenesses where applicable.
  • Users grant Egoist a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit, and display content solely to operate, improve, and provide the Service.
  • Egoist is a hosting platform for user-submitted content. Users are solely responsible for their uploads and for ensuring their content does not infringe third-party rights.
  • We may remove, disable access to, or restrict content at our discretion if we reasonably believe it violates these terms, third party rights, or applicable law.
  • We retain all rights to the Service's proprietary content and technology

6. Privacy

  • Our collection and use of personal information is governed by our Privacy Policy
  • Users consent to our data practices as outlined in the Privacy Policy

7. Payment Terms

Egoist has two subscription plans: Monthly and Annual plans where it allows you to get access to weekly progression videos and no ads.

  • If payment fails, we reserve the right to terminate your access to those additional features.

8. Termination

  • Users can delete their account to terminate the agreement and the service will delete all data related to the user.

9. Copyright and Trademark Complaints

  • If you believe content on the Service infringes your copyright or trademark, you may send a notice to giantte@egoist.app. If Egoist designates a separate copyright agent, notices must be sent to the then-current designated agent contact listed in these Terms and, where applicable, in the U.S. Copyright Office directory.
  • For copyright notices intended to comply with the U.S. DMCA (17 U.S.C. 512(c)(3)), include: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and information reasonably sufficient to locate it (such as URL); (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right allegedly infringed.
  • Egoist may remove or disable access to content while we review a complaint, may notify the affected user, and may act expeditiously to remove or disable access to material upon obtaining knowledge or awareness of claimed infringement.
  • Users who believe content was removed in error may submit a counter-notice. A DMCA counter-notice should include: (a) your physical or electronic signature; (b) identification of the removed material and its prior location; (c) a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and (d) your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or, if outside the United States, a U.S. judicial district where Egoist may be found) and that you will accept service of process from the person who submitted the original notice. We may restore content when appropriate and as permitted by law.

10. Repeat Infringer Policy

  • We may issue warnings or strikes for repeated or serious intellectual property violations.
  • Accounts with multiple valid infringement complaints may be suspended or permanently terminated.
  • Egoist adopts and reasonably implements a policy for terminating, in appropriate circumstances, users who are repeat infringers.
  • Egoist accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as required by applicable law.
  • We reserve the right to remove infringing content and restrict account features at any time to protect rights holders and the Service.

11. Limitation of Liability

  • To the fullest extent permitted by law, Egoist is not liable for user-submitted content, including claims that such content infringes third-party rights.
  • Egoist is a provider of online services that hosts user-submitted content and is not obligated to proactively monitor all user activity or all uploaded content for infringement.
  • We do not guarantee that user content is accurate, lawful, or non-infringing.
  • Nothing in these terms excludes liability that cannot be limited under applicable law.

12. Indemnification

  • You agree to defend, indemnify, and hold harmless Egoist and its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses (including reasonable attorney fees) arising out of or related to your content, your use of the Service, or your violation of these terms.

13. Modifications to Terms

  • We reserve the right to modify these terms
  • We will notify users via our website or email of the changes.
  • User's continued use constitutes acceptance of modified terms

14. Governing Law and Jurisdiction

These laws are governed by the United States of America.
